ALLENTOWN, Pa. - The recent firing of three city employees that has led to criticism ofMayor Matt Tuerk came after an outside investigation, the mayor's office said during an Allentown City Council meeting Wednesday night.

During the meeting, Councilmembers Ed Zucal and Ce-Ce Gerlach introduced a no-confidence resolution on Tuerk's leadership, which passed 4-3.

'No confidence': Allentown City Council votes 4-3 on Mayor Tuerk's leadership

Allentown City Council narrowly passed a no-confidence resolution that labels Mayor Matt Tuerk's leadership as "ineffective."

Leading up to the vote, the mayor's office shared new information related to the controversial firings.

The mayor's office said the recent firing of the three city employees was based on a recommendation after an 18-month-long outside investigation, which ended Nov. 2.

City Communications Manager Genesis Ortega says Tuerk met with outside counsel fromBingaman Hess, which conducted the investigation, as well asMacMain Leinhauser.Ortega said that "after careful consideration," the mayor decided to follow the recommendations put forth by the investigation and terminate the employment of the three individuals."

The administration also shared a prepared statement on the recent firings:

"In April 2022 the solicitor's office retained outside independent counsel to investigate multiple complaints involving employees within the city's human resources department," the statement said. It continued that, "due to the nature of the complaints involving individuals in that office and to ensure an impartial investigation, it was essential to involve external counsel as human resources could not conduct the investigation internally."

"The 18-month-long investigation involved interviews with 25 city employees," the statement said. "Following the conclusion of this investigation a report was generated recommending the termination of three employees in the human resources department."

Residents and councilmembers on Wednesday night wanted to know why it took so long to reveal the investigation and also why the three employees were fired weeks after the investigation's findings.

The mayor asked his objectors to stop speaking half-truths:

"People are entitled to opinions but not entitled to facts," Tuerk said.

But public commenters were not fully on board.

"Let's deal with actual facts," one commenter said. "A single mom was let go three days before Thanksgiving, right after the EEOC had given her the right to sue. Not only did you prove her case, you opened up our city for class action lawsuit."

"Do the right thing by these people. That's why we voted you in," Karen Ocasio, one of the three city employees who had been fired,told City Council in lobbying for the resolution's approval.

Later in the meeting, Nadeem Shahzad, the city's former human resources director, addressed council. Shahzad has claimed he was illegally fired by Tuerk.

"I have never stood and said anything negative about anyone I worked for," Shahzad said in opening. However, he stated that with Tuerk, he would make an exception.

"He lacks leadership, he has no compassion, he has no strengths to be a good manager. He's not transparent," Shahzad said.

"I think the city is going to suffer immensely through the lawsuits that will come," he continued. "You have no idea how many lawyers have called me from Allentown because they know this is a bonanza for them. This hurts me because of all the citizens of Allentown will pay when you have to raise taxes."

Shahzad concluded with an analysis of Tuerk's leadership style.

"He rules through fear," he claimed.
