    The chaos in Milton around their MBTA Communities (3A) compliance is just one example of why, whether it happens today or in 5-years, the Massachusetts Legislature will need to step in and implement more aggressive zoning changes to correct our growing housing crisis. Milton went through a 2-year extensive community process in an effort to comply with what will be a minimal change to the a Town's zoning code that was heavily restricted 50+ years ago to prevent largely any new housing production in the Town. In other communities, even compliance with the law will still not necessarily produce "as-of-right" housing production and many things like dimensional requirements, open space per unit mandates and parking minimums will inevitably preclude much of this newly zoned housing from being built. While 3A compliance is a needed tool, the process surrounding it in many communities is a sign that it sadly won't be nearly enough and we need to be adding more "tools to the toolkit" to enable more housing production across Massachusetts... before it's too late. https://lnkd.in/ex7yyJQx

    Governor Polis has signed into law legislation ending occupancy limits in Colorado. This prohibits cities like Builder from imposing occupancy limits that restrict how many unrelated people can live together. However, life safety and fire code occupancy regulations will still apply. The new law will take effect on July 1, 2024, and will repeal the current City of Boulder occupancy limit that allows up to five unrelated people to live together. This change raises important questions about access to affordable housing and the landscape of single-family home neighborhoods. What do you think?     Last week, Florida legislators passed a bill updating last year’s Live Local Act, including offering some concessions to single-family neighborhoods while ultimately expanding the law’s purview.Originally designed to increase workforce housing development, the Live Local Act’s main provision allowed developers to bypass local zoning restrictions on projects where at least 40 percent of units are priced as workforce of affordable housing. Since the law went into effect in July 2023, some communities have expressed concerns about lack of clarity in the bill. As a result, the 2024 bill was passed to clarify the legislation.“Instead of making a blanket change, [the law] was only enhanced in regards to that point of protecting single-family neighborhoods,” said #BilzinSumberg’s Anthony De Yurre, Esq, LLM, who was involved in developing the bill.
